ULTRA BEATS.SHOP TERMS AND CONDITIONS
1. Introduction
Welcome to Ultra Beats, an ecommerce webstore providing digital instrumental beats from Kosovo to the world. These Terms and Conditions (the "Terms") govern the use of our website (ultrabeats.shop) and any services provided through it.
2. Acceptance of Terms
By accessing and using our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services. Your continued use of our website and services constitutes your acceptance of these Terms.
3. Use of the Website
You agree to use the website in a manner that complies with all applicable laws and regulations. You will not use the website for any unlawful or prohibited activities, including but not limited to:
Hacking, spamming, or any other form of malicious activity
Posting or transmitting any content that is defamatory, abusive, or infringing on the rights of others
Interfering with the security or functionality of the website
4. Intellectual Property
All content on the website, including but not limited to instrumentals, text, graphics, logos, and other materials (the "Content"), is the property of Ultra Beats and is protected by intellectual property laws, including copyright, trademark, and trade secret laws. You may not reproduce, distribute, transmit, display, or use the Content without prior written permission from Ultra Beats.
5. Licenses
By purchasing a license to use our instrumentals, you agree to the specific terms and conditions of that license type as outlined on our website. You acknowledge that you have read, understand, and agree to be bound by the terms of the license.
6. Prices
Prices on website are in EUR (Euros) currency. The price that is seen at the CHECKOUT page when you place the order, is final and are no other hidden fees.
7. Payment methods
Payment methods are clearly written at the CHECKOUT page and also demonstrated at the bottom of the website with their respective logos. Ultrabeats.shop website accepts payments through bank transfers and Stripe. Stripe is a payment gateway provider which is very safe for the client and the merchant. Stripe offers wide range of payment methods including credit cards, debit cards, GPAY, Apple Pay etc.
If customer is sending payments through bank transfers, the customer is responsible to bear all the transfer costs.
Ultrabeats.shop bank account must receive the right amount as you see at the CHECKOUT page and as you receive order confirmation per email. If the amounts do not match, then Ultra beats has the right to contact you to pay the extra remaining costs or cancel your order completely and refund you. In case we refund the customer, the transfer costs from our bank account to the customer's bank account will be held.
8. After-sale and delivery of the product
After you have placed order by Bank Transfer, you are not able to download yet the music "beats" files. We must confirm that you have done the payment successfully at our designated bank accounts and in the proper amounts as described at the point 7 above. It may take from 2 to 5 working days to confirm the bank payments. Only after successful check of the received funds, Ultra Beats staff will change the status of your order as "PAID" and the customer will receive an email with conformation and a link to download the music files and the license agreement in PDF format.
When the customer places order through Stripe (ex: credit card, debit card, GPAY, Apple Pay etc), then the customer is responsible to finalize successfully the payment at the Stripe checkout page. Once the payment is successful then the order in Ultrabeats.shop will be marked automatically as "PAID" and the customer will receive an email confirmation with a downloadable link.
In case the customer has deleted the email and wants to download the music files again, then is possible to retreive the music files again by clicking "DOWNLOAD FILES" at the bottom of the page. The customer is required to enter either the e-mail address with which was placed the order or the ORDER ID number when was placed the order. For safety reasons downloadable links are clickable only once, if the customer did not download for some reason, is required to re-submit again retrieving the download links.
If in any case the customer is not able to download the music files and the license of agreement, then is required to contact the support staff by means listed below this page. The supporting staff shall send the files via email or point with the right steps for downloading.
9. Product type
Product or services offered at Ultrabeats.shop are digital music files formatted as MP3, WAV, Stems which are archived as ZIP or RAR type. Also the License Agreement is provided as PDF format file and must downloaded by the customer and printed in A4 size. We deliver instantly and on-demand at your own pace to download from our servers of Ultrabeats.shop website. This means that the products are digitally provided and downloaded.
Ultrabeats does not ship via postal courriers any products or services.
10. Refund Policies
No Refunds: Ultrabeats.shop is selling downloadable digital products as music.
"No refunds" policy due to the nature of the product being immediately accessible and potentially copied.
Ultrabeats.shop website is clear enough to point out the type of license you can purchase.
Each music provided at Ultrabeats.shop website has a preview button to play and listen all music instrumentals "Beats" before you purchase.
The music previews are full and lowered in quality and watermarked in sound/audio to not be copied.
The product types we offer are digital goods and downloaded instantly after your successful purchase.
Limited or Partial Refunds might be offered under specific circumstances, such as if the file is corrupt or there was a technical error with quality of the music files.
In Case of Disputes:
If a customer is dissatisfied, has the right to escalate the case at Stripe, that can help mediate the dispute.
Stripe will refer to the merchant's stated refund policy to determine the appropriate action.
11. Limitation of Liability
Ultra Beats shall not be liable for any damages, including but not limited to incidental, consequential, or punitive damages, arising out of the use or inability to use our services. In no event shall Ultra Beats' liability exceed the amount paid by you for the services.
12. Amendments
We reserve the right to amend these Terms at any time. Any changes will be posted on this page. Your continued use of our website and services after the effective date of any changes constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kosovo. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the Kosovo Chamber of Commerce.
